Lʼentreprise REJIM TRANSPORT VTC provides transport services by means of Chauffeur-driven Transport Vehicles (VTC), exclusively by reservation and at a previously defined estimated price. These rates are for a normal trip, excluding the cost of reservation fees, other expenses or dynamic pricing (see Article 1 detailing the potentially eligible expenses).

The registered office of REJIM TRANSPORT VTC is located at 13 rue Jules Froment, 69008 Lyon.

Lʼentreprise REJIM TRANSPORT VTC may subcontract its races to TAXI professionals who are also part of the T3P sector in the same way as VTC’s.

Lʼentreprise REJIM TRANSPORT VTC is registered in the trade register under the number 828 586 271 and in the Register of “Operators of Transport Car with Driver of the Ministry of lʼEnvironnement, lʼénergie and the Sea.”

Www.magic-vtc.fr and www.magic-vtc.com are both a commercial entity grouping together under the trademark Magic VTC © registered at the lNPI under the number 4590410, they are both domain names created on the support and partner OVH supervised by lʼentreprise ” REJIM TRANSPORT VTC. »

1 – PURPOSE

The purpose of these General Conditions is to define the conditions applicable to contracts for transport services concluded between www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) and its customers. They serve as a contract of sale.

By using the services of www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©), the customer is presumed to have read these General Terms and Conditions of Sale and to have fully accepted them either by tacit agreement (by having ordered orally by telephone (with the numbers: +33 4 69 14 29 28, +33 6 51 14 11, +33 7 69 14 29 28)), electronically on our sites www.magic-vtc.fr/ www.magic-vtc. com(Magic VTC ©), by phone (with the numbers: +33 4 69 14 29 28, +33 6 51 14 14 11, +33 7 69 14 29 28)) or in writing through a text message (with the numbers +33 6 51 14 14 11, +33 7 69 14 29 28) or email (with the following email address : contact@magic-vtc.fr) by filling out our online form, in writing on the WhatsApp networks (+33 6 51 14 14 11, +33 7 53 20 32 21), Facebook, Twitter, Tripadvisor, Google, Instagram mentioning our commercial entity Magic VTC © integrating our www sites. magic-vtc.fr/ www.magic-vtc.com, or on our online chat provided by our partner company Zendesk through the Zopim tool.

Either by having accepted electronically through an acceptance plugin module on the site and application generating an audit report acting as electronic proof of acceptance of the GTC, or by means of an electronic signature meeting the European EiDAS regulation subcontracted by the company and partner CM.COM.

This sales contract is a binding contract.

The reservation entails a firm commitment by the seller and lʼacheteur concerning (see principle of the deposit and deposit: Commercial Code. Deposits : Articles L232-12, L232-18 et seq., L622-33, R123-182 et seq., R232-17, R663-13, R663-31. Deposits: Code de la Consommation, Articles L131-1 et seq.).   :

– lʼobligation dʼacheter for the consumer ;
– and that of providing the merchandise, or the provision of service for the merchant.

It nʼy has in principle no possibility of forfeit for the customer. Consequence: If you refuse dʼexécuter the contract, you lose not only lʼacompte (if deposit paid), you must pay the total invoice if lʼoption of payment has been chosen in the form of “payment on board” under penalty of grievance (See the French Penal Code, Article 313-5).

But in addition, the merchant may require lʼexécution of the contract and claim damages in case of default.

2 – FORMATION OF THE CONTRACT FOR THE PROVISION OF TRANSPORT SERVICES

You accept the general conditions of sale by validating a quote, by making a reservation whether it is by phone, by email, on the site, on lʼapplication, under a tacit agreement, by validating the box “jʼai read and approved the GCS” on the site or by filling out a payment notice, an order form, an invoice, or by notifying in writing (by the means cited in Article 1 of this contract) with manual or electronic signature, preceded dʼune box with the following mention “jʼai read and approved the general conditions of sale good for agreement” or by integrating the additional mention “good for agreement. ”

The Customer can make a request for service 24/7 on the Internet sites www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©), on lʼapplication app store and playstore (Magic VTC ©), by the various means of existing social networks such as; WhatsApp, Facebook, Instagram, Twitter, TripAdvisor, Google or by telephone at +33 6 51 14 14 11/+33 7 69 14 29 28/+33 4 69 96 49 00 integrating the Magic VTC © brand.

The rates whatever the communication tool used will always be presented as an estimate of deposit. Except if the customer specifies that he would like a rate without additional costs on arrival, taking into account the various eligible costs specified on the said contract.

The customer provides all information concerning his request for service. He is solely responsible for this information, of which the following information is considered essential to the contract: date of the transport service, place of pick-up, place of drop-off, pick-up time, number of passengers (adult/child), number of luggage(s), with or without baby seat(s), with or without booster seat(s), nature of the service (transfer, provision, concierge service).

Exclusively on reservation and at a previously defined estimate price. These prices are for a normal race, excluding the cost of booking fees, other costs or dynamic pricing (see article – 3) detailing the potentially eligible costs).

The payment of the price is made in cash, by check. Or credit card via a secure electronic system (VADS, PLBS, PROXIMITY). Or by distance selling (VAD) whatever the means of communication used by the said contract through our external partner service providers: Payzen, Bnp, Paypal, MyPos, Amex or Intia.

By communicating his bank details, the customer accepts in advance and unconditionally that Www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) proceeds with the secure transaction (VADS, PLBS, PROXIMITY) and authorizes his bank in advance to debit his account for the amount of the service.

By communicating his bank details, the client accepts in advance and without condition that Www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) proceeds with the transaction distance selling (VAD) and authorizes his bank in advance to debit his account for the amount of the service.

After confirmation (acceptance of the GTC either by tacit agreement or on the various electronic media specified on the said contract, by the client of his request for service and payment of the estimated price of the deposit (indicated on a first order form, currently being processed and the first provisional order form if the order has been placed on the site or on the application)) sends him, in return, by email or other electronic means of communication stipulated on the said contract, a reservation form summarizing the information related to the service to be digitally signed.

The Customer can make a request for service 24 hours a day and 7 days a week on the Internet sites www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©), on lʼapplication app store and playstore (Magic VTC ©), by the various means of existing social networks such as; WhatsApp, Facebook, Instagram, Twitter, TripAdvisor, Google or by telephone at +33 6 51 14 14 11/+33 7 69 14 29 28/+33 4 69 96 49 00 integrating the Magic VTC © brand.

By communicating his bank details, the client accepts in advance and without condition that Www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) proceeds with the transaction distance selling (VAD) and authorizes his bank in advance to debit his account for the amount of the service.

After confirmation (acceptance of the GTC either by tacit agreement or on the various electronic media specified on the said contract, by the client of his request for service and payment of the estimated price of the deposit (indicated on a first order form, currently being processed and the first provisional order form if the order has been placed on the site or on the application)) sends him, in return, by email or other electronic means of communication stipulated on the said contract, a reservation form summarizing the information related to the service to be digitally signed.

Customer data is protected according to the RGPD. See the article on the said contract concerning the “General Data Protection Regulation” (GDPR).

The customer is responsible for verifying the information on the booking form. In case dʼimpossibilité for www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) dʼenvoyer by e-mail the said reservation form, the reservation is presumed to be in conformity with the client’s request.

3 – RATES

Www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) sets the price of the service according to the information provided by the Customer.

Exclusively on reservation and at a previously defined estimate price. These prices are for a normal race, excluding the cost of booking fees, other costs or dynamic pricing (see the article detailing the potentially eligible costs).

of the Rhône and Alpes-Maritimes. Thus to respect the break-even principle.

The prices indicated in our rates include VAT at the rate set by the regulations in force for transport services (10% for transfers, 20% for MAD provision), driver service, fuel and unlimited insurance of the persons transported, tolls are included in the transport.

Charges payable under the terms and conditions of the GTC: Vehicle damage, parking charges, waiting charges, travel expenses, dynamic pricing, night rate, approach charge, empty return trip, ice or snow road surcharge, detour, vehicle range charge regulation, reservation charges, cancellation, postponement, animal charges and valet or concierge service, new trip regulation charges or request for service of any kind.

Method of calculation for the deposit: dʼestimation rate for the outward transfer to the fixed price and not fixed (for payment on board) or dʼestimation rate for the fixed price and not fixed dʼapproche or empty return of the transfer + (or not) 50% of the reservation fees of the price excluding VAT of this rate = amount of the deposit which can be cashed as a consequence of the different fees payable. The deposit is rounded up to the nearest ten, a hundred or a thousand.

Under the Consumer Code – Article L112-3: Only the variable 15% to 50% reservation fee is not included in the price, as well as any costs related to traffic and late surcharges, dynamic pricing (linked to lʼoffre and demand or night high to dʼun coefficient of 1.4) or the fare dʼapproche, the rate for returns or empty trips (rate dʼapproche): both rates are less than or equal ( 0% to 100%) to the rate dʼestimation proposed for the transfer.

Reminder of the fees payable as provided for in the terms and conditions of the GTC: Vehicle damage, parking fees, waiting fees, travel expenses, dynamic pricing, night rate, approach rate, empty return, ice or snow road surcharge, detour, regulation of vehicle range fees, reservation fees, cancellation, postponement, animal fees and valet or concierge service, fees regulation of us beautiful race or request for service of any kind.

The packages offered by the platform are considered as a flat-rate estimate and are not fixed prices, so they include a precise travel time and a precise number of kilometers calculated by Google Maps mapping integrated into the price simulator on the sites www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) and the Appstore and Playstore application.

Beyond this estimate the package will be exceeded and the customer will be considered as out of the package. In this case the fees potentially payable will be applicable as additional charges.

Reminder of the thermal package:

“The bundle is a pricing element, defined at lʼavance and independent of the quantities consumed or produced.
It can also be the fixed term dʼune mixed pricing which then also includes a variable term for quantities above a certain threshold.
Conclude fixed-price term nʼempêche not to take into account lʼinflation by a revision formula.
This term can for example be used in the following cases:
telephone package, internet package, including either a minimum number of minutes (fixed term) or a subscription for a duration independent of the actual consumption.

Reservation fee reminders :

What are reservation fees?

Www.magic-vtc.www.magic-vtc.com (Magic VTC ©) charges a reservation fee to tenants who book on our platform.

As you know the VTC is a car rental service with driver.

These fees allow us to cover some of the operating costs of our websites, in particular :

ensuring the security of transactions
develop websites and improve the user experience
provide 24-hour assistance to owners and travelers *marketing: you ensure good visibility on the internet and easy access to our platform and in some cases guarantee a fixed price.

How are these booking fees calculated?

The reservation fee is a percentage of the total rental price. Their amount generally varies between 15 and 50% of the total amount excluding VAT.

Sometimes they may be offered as part of a commercial gesture.

The fees are variable and cannot be displayed in a fixed manner beforehand, the Commercial Code under the Consumer Code – Article L112-3 obliges us in such cases to annotate on the order form “that there are reservation fees as part of the fees payable. »

Note: the security deposit and taxes are not taken into account in the calculation of the reservation fees.

Are the reservation fees refundable?

If the tenant cancels the reservation, the cancellation conditions you have chosen will apply and the reservation fees will not be refunded.

Please note that the reservation fee is non-refundable:

If you cancel the reservation, the tenant will not be refunded if a deposit, down payment or security deposit is paid.

Only a non-refundable credit note will be issued to be used without any time limit.

If a customer orders and the platform will not be able to honor a race in a case of force majeure, www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) may, as a commercial gesture, propose the refund of the race in the form dʼavoir. The platform does not reimburse any amount advanced in the form of cash.

The rate of these fees are fixed to cover the time of the switchboard, site maintenance, order form, billing and booking. They are also calculated according to the market fees of the independent secretarial sector. The median rate excluding VAT is €30 per hour.

The expenses of empty return or the expenses dʼapproche will depend on the calendar of reservation, the increase of delay, of night or traffic will depend on the traffic or the delay of the customer so a guarantee or during the transaction will be blocked of the total amount of all these expenses to lʼaide dʼune banking imprint.

The rest of the surcharge fees are calculated according to the actual situation; namely : Vehicle damage, parking fees, waiting fees, travel expenses, dynamic pricing, approach fee, empty return, ice or snow road surcharge, detour, vehicle range fee regulation, reservation fees, cancellation, postponement, animal fees and valet or concierge service, fees for regulation of new trips or request for service of any kind.

All fees potentially payable under the said contract may be communicated to the customer after the service or communicated to the customer on board the vehicle, in accordance with the prefectoral decrees on cab fares in the Rhône and Alpes-Maritimes regions.

All potentially payable fees have been communicated to the client under the Consumer Code – Article L112-3.

Part or all of the deposit will be cashed according to the various factors mentioned above (on the said contract), in particular where the client does not show up on the day of the reservation. In this case the deposit will be cashed in full. All these fees are variable and communicated to the client in accordance with the Consumer Code – Article L112-3.

The proposed prices are linked to two types of vehicle in transfer: ECO class (type Mercedes Benz Sedan or SUV) and VAN (type Mercedes Benz CLASS V).

The package nʼest applicable only for the eco class. The pricing in VAN is at the horokilometer.

Any time if the customer does not reserve within the time limits (24 hours before) the horokilometric will be applicable in particular to the eco sedan. Pricing varies according to the season, please refer to the price list: https://www.magic-vtc.fr/tarifs-devisgratuitenligne/.

The business class is at the same price as the NPV. For example: “Mercedes-Benz E-Class” vehicle model.

Thus, if there is a lack of eco vehicle, a business class vehicle will be sent to you for your pick-up and sʼajouteront charges in addition specified on your order forms under the Consumer Code – Article L112-3.

What the extra package includes: traffic surcharge, delay surcharge, availability surcharge, night surcharge, surcharge linked to a dynamic pricing system that varies according to lʼoffre and the demand and whose coefficient will be completely free for the driver to choose (the dynamic pricing system includes, in particular for cases of force majeure, the change of vehicle category), reservation fees, the dʼapproche rate, ice or snow surcharge, empty return fare, luggage service or other service such as a sign, valet service, etc. (potentially payable fees specified on the said contract)….

The reservation, delay, traffic, dynamic pricing, luggage service, other service and fees potentially payable (specified on the said contract) not included in the package offered by the platform or the night surcharge, ice or snow surcharge will be deducted on board the vehicle, by direct debit, payment on board by check or cash.

Because any type of reservation, whether already paid or not, will make lʼobject dʼune bank imprint to prevent any act of grief including “no show” (specified on the said contract),

The withdrawal or payment on board the vehicle may be justified at the request of the customer, by e-mail with a pro-format global invoice including the potential charges payable (specified on the said contract), by simple notification without specifying the overall cost or with an umpteenth electronic or manual order form, presented on board the vehicle by the driver or by e-mail expressing the total cost of your tariff according to the procedures established and specified on the said contract in articles 2 and 1.

The packages are applicable only when the customer reserves 24 hours at lʼavance.

Lʼempreinte bank Lʼempreinte will also be used to deduct lʼacompte equivalent to the sum of the invoice if it is reserved before quʼelle is paid by credit card or if the customer chooses the payment on board.

4 – PAYMENT

You hereby authorize the company REJIM TRANSPORT VTC and the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) to submit your payments by all these means of payment: Accepted payment methods: Cash, bank transfer, checks, credit cards (Visa, MasterCard, Amex etc.. in VADS or VAD).

Any transport service by transfer or provision is payable with the order. Remote payment over the phone by providing us; copy of dʼidentité card, bank card and lʼavis payment, order form or invoice completed and signed.

By accepting the general conditions of sale, the customer authorizes lʼutilisation of his credit card as well as the safeguard of his data for the remote payments and for dʼautres potential reservations as well as for all the expenses which will come sʼajouter after the service and once the service is established within an indefinite authorized limit. The customer hereby agrees to the storage of all his personal information for potential commercial purposes.

Customer data is protected according to the RGPD. See the article on the said contract concerning the “General Data Protection Regulation” or GDPR.

Payment on board: As in all businesses, when you book nʼimporte which service the merchant will always ask you for a guarantee.

In this case it sʼagit of the car rental with driver with a facility of “payment on board”. »

So it goes without saying that lʼentreprise asks for a guarantee which will allow you in addition to that to ensure you a driver at the time of the pickup.

Reminder of our procedure during the formation of the contract in article 2:

After confirmation (acceptance of the GCS either by tacit agreement or on the various electronic supports specified on the aforementioned contract, by the customer of his request for service and payment of the price of estimate of deposit (indicated on a first purchase order, in the course of treatment and first provisional purchase order if the order was placed on the site or on the application)) sends to him, in return, by email or other electronic means of communication stipulated on the aforementioned contract, a reservation form recapitulating the information related to the service to be digitally signed.

Lʼentreprise REJIM TRANSPORT VTC as well as the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) reserve the right to deduct any sum plus compensation costs on the basis of the information provided by the customer in case of fraud (grivélerie or filouterie) article 313-5 of the Penal Code.

The payment on board is considered as a commercial gesture and postpones the payment of the outward journey until the service has been carried out. If the customer wishes to cancel the trip, the customer will have to pay the totality of the price of the trip.

For payments on board a guarantee will be requested, it sʼagit dʼune bank guarantee in the form of a pledge that will guarantee the ability dʼun customer to pay the fees in case of charges due under the terms of the GTC : Damage to the vehicle, parking fees, waiting fees, travel expenses, dynamic pricing, approach fees, empty return trip, ice or snow road surcharge, detour, regulation of vehicle range fees, reservation fees, cancellation, postponement, animal fees and valet or concierge service, fees regulation of new races or request for service of any kind.

A deposit will be taken in the event of failure to meet the customer’s commitments as stipulated in the said contract, and a bank imprint will be made in the amount of the sum due by the customer entered on the first order form or the final order form.

The company REJIM TRANSPORT VTC as well as the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) reserve the right to take in addition a sum in the framework dʼun prejudice for compensation. This sum is fixed by the company REJIM TRANSPORT VTC. But lʼempreinte bank made upstream nʼest quʼun pledge deposit so as to guarantee you a driver for your pick-up and commitment to the honorability of our services.

In case of late payment :

Every 45 days the invoice will be increased by 4.16% as provided lʼ Art L 441-6 of the Commercial Code.

And this excluding bailiff management fees and dʼhonoraires dʼavocat, disbursements and expenses.

The rate of delay for professionals is freely set by the merchant in accordance with the law.

Payments are cash. The cash payment: the customer has lʼobligation to pay the good or service on the day of delivery or realization.

The rate dʼintérêt provided by the GTC generally corresponds to the key rate (refinancing rate or Refi) half-yearly of the European Central Bank (ECB), in force on 1 January or 1 July, increased by 10 points.

Example: 10.00% (0.00 + 10) for penalties due since July 1, 2019. 5 – RESERVATION AND CANCELLATION

5 – 1 – RESERVATION :

Any reservation implies lʼacceptation without reservation of the present general conditions of sale.

The customer and the provider sʼengagent to respect all the clauses quoted in this contract.

No modification can be made to the above conditions except prior agreement between the parties.

The present contract would be suspended by the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©), the assumption of responsibility could be postponed or cancelled by right and without compensation (this includes in particular the refunding of the race) www.magic-vtc.com kind in all the cases recognized of absolute necessity (event external to www.magic-vtc.fr/ dʼaucune (Magic VTC ©)) such as the disturbance of the ways of circulation, bad weather, of demonstration, dʼaccident, breakdown or dysfunction of the telecommunication networks, shortage of hand dʼœuvre or materials …

The contract nʼest deemed concluded quʼune once the order is placed through the various communication tools delivered by the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©).

Either by having accepted electronically through an acceptance plugin module on the site and application generating an audit report acting as electronic proof of acceptance of the GTC, or by means of an electronic signature meeting the European EiDAS regulation subcontracted by the company and partner CM.COM.

Particularity for a pick up at train station and airport :

As soon as you arrive, turn on your cell phone.
The driver reserves the right to postpone the pick-up according to the terms and conditions stipulated in the said contract.
Please note in “additional information” at the time of booking the flight or train number or any other information to facilitate the pick-up or to personalize your trip (welcome sign, concierge, music playlist, still water, sparkling water, etc…).

For flights, if you nʼavez no checked baggage in the hold, the 15 minutes dʼattente offered included in the trip are generally sufficient. However, if you have to retrieve checked luggage and/or if you come dʼune non-European destination, the exit time of lʼavion, baggage retrieval and lʼéventuel force control of lʼordre require quite important delays.

In order not to have to pay a wait, we advise you dʼajouter a margin of 30 minutes for your pickup.

A 30 minutes beat is granted to the driver from lʼheure to take over the order form.

For example: if your pick-up is set at 12:00, the actual pick-up will be made between 12:00 and 12:30.

The rate of payment of lʼacompte is 100% of the price of the estimate, including VAT. (Article L. 114-1 of the Consumer Code).

Thus the customer has lʼobligation to pay in full his “return trip” in the form of dʼacompte estimate, and the rest of the order form or invoice integrating the potential round trips or returns.

The payment on board is considered as a commercial gesture and defers the payment of the outward journey to the realization of the service. If the client wishes to cancel the trip, he will have to pay the totality of the price of the estimate of the trip.

For payments on board a guarantee will be required (see Article 3 of the said contract), it sʼagit dʼune bank imprint that will guarantee the ability dʼun customer to pay the potentially payable fees stipulated on the said contract.

5 – 2 – CANCELLATION :

A reservation cannot be cancelled by the customer.

Any sum advanced by the client in cash, by check, by credit card or online payment is considered a deposit. If the customer refuses to complete the reservation or lʼinscription and decides dʼannuler the race the sum will be lost in its entirety under the terms of lʼarticles L21 4-1 to L214-4 of the consumer code.

If a customer orders and that the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) could not honour a service in a framework of force majeure (cited on the said contract), www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) will be able to propose the reimbursement of the race in a commercial gesture in the form dʼavoir non-refundable in the form of cash. A credit note valid for an unlimited period of time. The platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) does not reimburse any sum advanced in the form of cash.

The payment on board is considered as a commercial gesture and postpones the payment of the outward journey until the service has been carried out. If the client wishes to cancel the trip, he will have to pay the totality of the price of the service.

In case the customer refuses to pay his invoice or his order: the platform reserves the right dʼencaisser the amount of the deposit which will be equivalent to the amount of the price of the race as well as expenses and indemnities in addition. The indemnities will be inspired up to 50 to 100% of the price of lʼamende that the law provides in case of grief, 7000€, under lʼarticle 313-5 of the Penal Code.

Any sum paid to lʼavance on the sites www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) and the AppStore and Playstore application (Magic VTC ©), or directly to an agent or the manager, will be considered as a deposit whatever the means of payment used.

Reminder :

Lʼarticle articles L214-1 to L214-4 of the consumer code which stipulates that :

Lʼacompte is a sum paid in advance by a customer at the time of dʼun purchase. Lʼacompte entails a firm commitment of the seller and lʼacheteur concerning :

– lʼobligation dʼacheter for the consumer ;
– and that of providing the goods for the merchant or the provision of service ;

It nʼy has in principle no possibility of forfeit, neither for you, nor for the tradesman. Consequence: If you refuse dʼexécuter the contract, you lose not only lʼacompte, but in addition the merchant can demand lʼexécution from the contract and claim damages in case of default.

Not paying a simple order is punishable by law. The grivèlerie is forbidden in France.

The term used in the French penal code is “filouterie”. Under lʼarticle 313-5 of the Penal Code.

Cʼest an act that consists in ordering a service that lʼon will refuse to pay for, or of which one is aware that lʼon nʼaura cannot afford to pay for.

The offense is constituted if :

the service has been ordered by the customer ;
the service has been consumed (meal started or finished, room occupied, cab ride made, fuel tank filled, etc.) ;
the customer is in lʼimpossibilité material to settle his debt or is determined before consuming to not pay;

lʼintention fraudulent intent is recognized (this fraudulent intent must be prior to consumption, the offense nʼest not necessarily constituted, for example, if the consumer forgets to pay because busy on the phone, or leaves suddenly because dʼun event of force majeure or even because quʼil would be disturbed by smoke or commotion).

In common parlance, we will speak of trickery for serious acts, and of free riding for less serious acts.

Examples of trickery :

Leaving a restaurant, a bar, a hotel after sʼêtre is served, without paying lʼaddition or the bill;
being served fuel and leaving without paying.
take a cab and leave without sʼacquitter of the fare.

Examples of free riding :

Taking the train without a ticket (variant: traveling first class with a second class ticket) ;
not sʼacquitter of the toll ;
do not pay for parking ;

“cheat” on one’s age for example in order to benefit dʼun from a reduced fare (cinema, museum, etc.).
Penalty in French law

The filth is punishable by a sentence of six months dʼemprisonnement and € 7,500 dʼamende and possibly by a complementary penalty (for example: prohibition dʼémettre of checks) or substitution (for example: work dʼintérêt general).

This penalty can be compared to those for acts of queue-jumping, which are generally punished by a fine (less than €1,500).

5 – 3 – PRICE INCREASE / DELAY / TRAFFIC JAMS

Any delay of the passenger(s), or any delay exceeding lʼheure of the package indicated on our simulator www.magic-vtc.fr/ www.magic-vtc. com (Magic VTC ©) and the AppStore and Playstore application (Magic VTC ©) or any deviation in excess of the Km indicated on our simulator or in relation to lʼhoraire of the pick-up indicated in the provisional or final reservation form, will lead to an increase in the price of the service, in particular if the customer informs the driver in advance by telephone at +33 4 69 96 49 00/+337 69 14 29 28/+33 6 51 14 114 11 for delays as follows :

More than 15 minutes late: 10 euros
More than 30 minutes late: 25 euros
For any additional half hour delay: 25 euros.

This amounts to 0.83 cents per minute, these prices also apply to heavy traffic or traffic jams or any type of deviation due to unforeseen events such as disruption of traffic lanes (works, etc.) bad weather, event, dʼaccident, breakdown or malfunction of telecommunications networks. This price therefore applies in the form of traffic surcharges as stipulated in the said contract. It may be noted either by an agent, the driver or by means of a horokilometric meter on board the vehicle as permitted by the VTC regulations in force as well as the Thévenoud and Grand Guillaume laws.

The payment of these surcharges takes place at the latest when the passenger(s) get(s) into the vehicle. Or at the end of the race.

In case dʼabsence of the customer on the place of the meeting, beyond the first 15 minutes free of charge, without any demonstration on his part, nor any answer to lʼappel telephone of the driver, the service will be definitively lost, without possibility of postponement and without being able to claim any refund.

6 – QUALITY OF SERVICE

The transport of persons for payment is a regulated activity.

Only authorized vehicles may perform this service and :

Munis dʼun professional card number issued by the prefecture.
Munis dʼune certificate dʼimmatriculation issued by the Ministry of lʼÉcologie, Sustainable Development and lʼÉnergie, Office of lʼorganisation of the road transport of passengers / VTC center.
Munis dʼun badge dʼimmatriculation affixed to the windshield of the vehicle. www.magic-vtc.fr sʼengage to carry out or to make carry out the services of transport in accordance with the reservation form and in the respect of any regulation and legislation in force.

In case of subcontracting, the platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) of lʼentreprise REJIM TRANSPORT VTC sʼassure that the persons and companies it calls upon meet the same conditions.

7 – RESPONSIBILITIES

Www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) is guaranteed by a notoriously solvent company dʼassurance which covers the risks related to its activity in accordance with the regulations in force.

In the event of litigation, the responsibility of lʼentreprise www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) could not be retained quʼà the condition for the customer to bring back the proof dʼun faulty behavior of the latter and dʼun causal link with the invoked damage.

Lʼassurance unlimited multi-risk of lʼentreprise www.magic-vtc.fr covers the responsibilities related to lʼentreprise.

The customer is legally and criminally liable for his actions.

 

7 – 1 – RESPONSIBILITY OF THE CUSTOMER AND THE PERSONS TRANSPORTED

The customer sʼengage for himself and for the passengers for whom he has contracted with www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) to behave like a good father from the moment of pickup, in particular, respecting the driver and transport equipment as well as the following provisions :

Respect for the rules of the Highway Code (wearing of seatbelts, car seats, booster seat …),
Prohibition of smoking, eating and transporting dangerous materials.

If necessary, your driver will make a stop along the way.

It is forbidden to consume lʼalcool on board the vehicle.

Luggage is accepted and remains the responsibility of the customer.

The platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) of lʼentreprise REJIM TRANSPORT VTC cannot be held responsible in case of damage and/or loss of luggage or electronic device (telephone, tablet etc).

Any damage to the vehicle, due to the customer, will be entirely at his expense.

For any other damage leading to the immobilization of the vehicle: – Invoicing in real terms + Costs dʼimmobilisation + Lack of profit in figure dʼaffaires on an average of the last 3 months.

In case of damage leading to a cancellation of the following service, a fixed fee of 150.00 € will be applied in addition, payable immediately by credit card, cash or check.

The cleaning in case of vomit will be charged 150,00€ including all taxes in addition to the service payable immediately by credit card.

The pets, small or large sizes, are accepted, with conditions dʼêtre in a cage of transport.

Large size dogs dʼassistance are allowed. The Transport with animal will be charged of 150€.

Failure to comply with these provisions engages the exclusive responsibility of the customer and passengers both at lʼégard from www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) and third parties.

The platform www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) of lʼentreprise REJIM TRANSPORT VTC declines any responsibility concerning the actions of its customer before and after his transport. www.magic-vtc.fr/ www.magic-vtc.com (Magic VTC ©) reserves the right to refuse the taking in charge, or to disembark, a passenger who would not respect these obligations, as well as quʼun alcoholic passenger.

These potentially payable charges are communicated to customers under the Consumer Code – Article L112-3.

7 – 2 – COMPLAINTS

Any complaint nʼest admissible only within 5 days from lʼexécution of the concerned transport service. Any dispute is the responsibility of the Courts instead of the Head Office of lʼentreprise REJIM TRANSPORT VTC.

8 – PROVISION / TRANSFER 8 – 1 – TRANSFER :

The service of transfer starts from lʼadresse from the headquarters of lʼentreprise REJIM TRANSPORT VTC and sʼachève from lʼarrivée from the client to lʼadresse provided.

8 – 2 – PROVISION :

Provision MAD : the transport is in limited mileage within the framework of provision at lʼheure :

25 kilometers for 1 hour of availability,
125 kilometers for 5 hours of availability. Any hour started is due in full.

Our simulator informs you that on an estimate. An estimate will have to be established for the provision (MAD) and the prices are not fixed.
